Observing that mere suspicion of a woman about her husband's affair with another woman cannot be a ground for divorce, the Bombay High Court has set aside a divorce granted to a techie and his lecturer wife by a family court in Pune. After marriage, no wife will tolerate the company of another woman in her husband's life, observed Justice P B Majmudar and R V More on Thursday. Quashing the divorce, the judges asked the couple, Rajesh and Smita (names Changed to protect identity), to come together and learn to adjust with each other more particularly as they have a small child to raise. Rajesh had sought divorce from his wife on the ground of cruelty alleging that she suspected him to have an affair with Reena, a family friend. He also alleged that Smita called up his friends to inquire whether he had affair with any woman. This, he said, amounted to cruelty. Smita, on the other hand, argued that her husband used to come home late night and also long chats with Reena on the internet. She had also seen them eating from the same plate. The high court observed that wife's suspicion was justified. The judges said a wife normally expects her husband to be at home within reasonable time at night and if regularly came home late night any wife would have reasonable apprehension about the character of her husband.
