he BAL degree offered by the Annamalai University and the BGL by the Madurai_Kamaraj University are not equivalent to the Bachelor of Law, the Madras High Court has observed. Justice K Chandru made the observation while dismissing a writ petition from N Pushpa, possessing BAL and BGL offered by the Annamalai and Madurai-Kamaraj Universities respectively, seeking promotion as Assistant Law Secretary in the Law Department. It must be noted that the Advocates’ Act and the rules framed, namely, the Bar Council of India rules, undoubtedly covered the field of legal education. Therefore, it could never be contended that the degrees in law offered by Annamalai University, Madurai-Kamaraj University and the Madras University, having been recognised by the University Grants Commission (UGC), should be accepted. Since the Advocates Act was referable to Entry 66 of List I of VII Schedule of the Constitution, it would certainly prevail over the State Universities Acts. It could never be contended that they operated on different areas, the judge stated. “There is no doubt that the stand taken by the government was consistent with the provisions of the Advocates Act and the UGC Act and, therefore, no one can find fault with it,” the judge said and dismissed the petition.
