SC must not appeal RTI order on CJI: Ex SC Judge

Former Bihar and Jharkhand Governor and Supreme Court Judge M Rama Jois said the Apex Court should desist from appealing against the Delhi High Court order bringing Chief Justice of India (CJI) under the ambit of the RTI Act.
In a statement here, the Former Chief Justice of Punjab and Haryana High Court said it was better for the Supreme Court not to choose to appeal against the recent verdict which was welcomed by many.
The BJP Rajya Sabha member said the High Court verdict was (though) undoubtedly the proof of independence of judiciary, the fact that such an occasion arose for the high court is unfortunate.
‘An appeal, if at all the Supreme Court prefers is, in my humble opinion, incongruous. This might expose the Supreme Court of becoming a ordinary litigant,’ he opined.
Following the judgment, it was appropriate for Union Government to make a clarificatory statement to the RTI Act or seek a Presidential Reference on the scope and ambit of the law under Article 143 of the Constitution.
