A petition was filed by 10 Delhi Judicial Services 2019 unsuccessful candidates pointing out the ‘patently erroneous questions’ in the examination and seeking the re-evaluation of their marks after correcting of the erroneous questions.
The Division Bench of Justice Muralidhar and Justice Takwant Singh relied upon the law stated by the Supreme Court in Pallav Mongia v. Registrar General, Delhi High court, that the current results of the 353 candidates are to be left undisturbed but also ordered the High Court to recomputed the results of the remaining candidates by applying the correct answer keys as decided by the Court.
The Division Bench pointed out 9 mistakes in the answer key and noted that it has caused substantial prejudice to the petitioners. The Petitoners on the other hand also prayed for the directions to be issued to Registrar General of the Delhi High court to postpone the DJS Mains exam till the correct result is uploaded.
Delhi High Court rejected the contention of delaying the exam and ordered the Registrar to add the list of eligible students in the Mains exam list.
