Supreme Court Dismisses Appeals of Maharashtra Govt, Anil Deshmukh against CBI Enquiry on Param Bir Singh's Allegations
On Thursday, the SC dismissed the petitions filed by Maharashtra Government and its former Home Minister Anil Deshmukh challenging the Bombay High Court direction for CBI preliminary enquiry on the allegations raised by former Mumbai Police Commissioner Param Bir Singh.
The SC bench asked Sibal (appearing for Deshmukh) “what was the harm in that.” Sibal replied that “the High Court cannot order CBI investigation on the basis of documents which are not admissible in evidence, that too without hearing the affected party.” On this basis the SC replied, “you cannot pick and choose the agency", Justice Kaul responded.

The Bench comprising of Chief Justice Dr S Muralidhar and Justice BP Routray viewed that as per a notification issued in June 2012, the service tax liability of an advocate for legal services rendered is nil, and despite this the tax department has issued notices to lawyers demanding payment of tax. The court observed that, practicing advocates should not have to face such harassment, the Court went on to observe before adjourning the matter until April 22.
Supreme Court in Rohingyas Case: 'Right to not be deported' is Ancillary to a Fundamental Right Available
Chief Justice of India SA Bobde, AS Bopanna and V. Ramasubramanian observed that the Rohingyas in Jammu shall not be deported unless the procedure prescribed for such deportation is followed.
The Supreme Court observed after rejecting a plea to stop the deportation of Rohingya refugees detained in Jammu, the right not to be deported is ancillary to the fundamental right to reside or settle in any part of India guaranteed under Article 19(1)(e) of the Constitution.
Apex Court Issues Notice In Plea against Alleged Use of Banned Chemicals by Firework Manufacturers
The Bench, on Thursday observed that, the issued notice in application filed against alleged use of banned chemicals by firework manufacturers, mislabeling of products contrary to Apex Courts directions.
Mr. Sankaranarayanan (appearing on behalf of the applicant) contended that, many of the respondents-manufacturers are still using the same chemicals which have been banned by the Supreme Court under various orders, and many of them are also not labeling their products as ordered by Supreme Court's order dated 10th Feb 2017.
