ALLAHABAD HC GIVES GREEN SIGNAL TO RAIL COACH FACTORY IN RAI BARELI 12/18/2008 The Lucknow bench of the Allahabad High Court lifted the status quo orders on the land, at which Rs 2,200 crore rail coach factory was proposed to be set up in Re Bareli -- the parliamentary constituency of Congress President Sonia Gandhi. The bench comprising Justice Pradeep Kant and Justice Shabihul Hasnain asked the ministry to commence the factory construction work at the proposed Lalganj area, besides ordering the state government to complete the lease work within a week. The bench passed this order on a petition filed by the Railway Ministry of the Government and fixed January 21 as the next hearing date into the case. The counsel of the petitioner said they object the conditions of lease kept by the state government on the land for the coach factory at Re Bareli as they were ‘illegal’ and ‘unconstitutional’. As the state government has made to the complete payment, question of conditions on the said land does not exist, he added. Earlier on October 13, the same Bench had passed a status-quo order on the land, saying neither possession of the land would be taken back from the Railway department, nor the land would be allotted to anyone by the state government. The order was passed on two writ petitions -- one filed on behalf of Union of India and another by Avnendra Pandey and Dinesh Chandra Mishra on behalf of the farmers of Ahar village in Re Bareli district. The Court had then given one week’s time for respondents i.e., the Uttar Pradesh government to file the affidavit. The order stated that the status-quo on the land had to be maintained with no construction and allotment of land to anyone till further orders.
