Lawyers Protest CrPC Alteration 20 Jan 2009, 0030 hrs IST, TNN CHANDIGARH: Bolted doors, locked chambers and empty courtrooms welcomed litigants, who visited city’s district court on Monday, owing to the strike called by District Bar Association in protest against the recent amendments in CrPC. The cases fixed for hearing on Monday were adjourned and the presence of lawyers on the premises was miniscule. The protest staged by local legal community was due to the request forwarded by Delhi and NCRs Bar Association. The lawyers gave a mixed verdict to the changes in CrPCs sections 41A (1) and 41A (3) wherein the police will issue a notice of appearance instead of arresting the accused in case of FIRs registered under sections where punishment extends up to just seven years. The experts pointed out that this development would leave many accused free in offences like criminal intimidation, cheating, theft, attempt to culpable homicide, robbery, attempt to suicide, kidnapping, causing miscarriage, cheque bounce, abandoning kids, voluntarily causing grievous hurt, outraging a woman’s modesty and death caused by negligence. Citing evidence, they argued that city police registered 1991 theft, 477 accident and 217 cheating cases in 2008. They added that the accused booked in such sections would not require bail. DBA president NK Nanda cautioned: The move instead of curbing crime will increase it tenfold. Earlier, owing to their fear of being caught on the wrong side of law, miscreants didn’t indulge much in crime. But now, this fear will vanish.
