CJI Constitutes 5 Member Bench For Amarinder Singh's case Dated : 22-02-2009 Source : UNI Delhi : Text : Chief Justice K G Balakrishnan has constituted a five-judge constitution bench headed by himself, to hear the petition filed by former Punjab Chief Minister Captain Amarinder Singh challenging his expulsion from the state Assembly in the Amritsar land scam. Other judges on the bench are Justices R V Raveendran, P Sathashivam, J M Panchal and R M Lodha. The bench will hear the petition on February 23 to fix next date for hearing of the case. The petition of Captain Amarinder Singh was referred to the constitution bench by a three-judge bench headed by Justice B N Agarwal. The main issue referred to the constitution bench was whether an MLA can claim that only the Assembly during whose tenure the scam has taken place can initiate the proceedings against erring MLA and the subsequent Assembly is not competent to initiate such proceedings. Captain Singh has been facing allegations in allotment of 32 acres of land to Amritsar Improvement Trust during his tenure as the Chief Minister. Punjab Assembly Speaker Nirmal Singh Kahlon has constituted a special committee and the Assembly passed a resolution directing the committee to conduct a probe in the alleged scandal. The former Chief Minister has also challenged the validity of the constitution of special committee on the ground that criminal investigation can be conducted only by a investigating agency and such special committee cannot be given police power. He was disqualified as MLA by the Assembly last year. According to him, the breach of privilege proceedings initiated by the Akali Dal government headed by Chief Minister Prakash Singh Badal was politically motivated. UNI
