Lecturers and school teachers, who had obtained appointments, promotions and transfers without following statutory rules in collusion with the management, cannot be allowed to continue in the posts, the Madras High Court has held.

Justice S. Manikumar passed the ruling while disposing of a batch of 48 writ petitions filed in the Madurai Bench by teachers and office-bearers of Tirunelveli Diocesan Trust Association (TDTA) which administers five colleges and 335 schools.

Election for the office-bearers of TDTA was held in four phases between October 17 and December 21, 2007. After commencement of elections, members of one of the factions that ran for election filed a case in Chennai city civil court to declare them as winners. The civil court on July 21, 2008 ordered to maintain status quo as on December 21, 2007. Aggrieved against the order, the Bishop of Tirunelveli Diocese filed a civil revision petition before the principal seat of the High Court in Chennai.

The High Court on August 18, 2008 quashed the lower court order and directed that the contestants, who were certified by the Bishop for having been duly elected in the 2007 election, shall continue to administer the diocese. Pursuant to High Court order, the new management barred teachers who had obtained appointments and promotions from the faction that occupied office on the strength of civil court orders and hence the batch of writ petitions.
