SC offers relief to Orissa's FTC judges

NEW DELHI: The Supreme Court has ruled that nine Additional District Judges (ADJs) of Fast Track Courts in Orissa, who were appointed on ad-hoc basis, need not appear for any fresh examination being conducted for appointment of regular judges. A bench of Justices Arijit Pasayat and P P Naolekar, in a recent order, said "there shall not be any need for them to appear in any examination meant for recruitment to the cadre of District Judge." The apex court passed the order on a special leave petition filed by Madhumita Das and eight other aggrieved ADJs questioning the decision of Orissa High Court (administration wing) to fill up 16 vacancies in the state judicial officers' posts by conducting a fresh recruitment drive. According to the petitioners, even after putting in their services as ad-hoc judges, the fresh recruitment drive by the High Court made it mandatory for them to undergo tests like other candidates. They submitted that the age of some of them was more than 45 years, the maximum age prescribed for fresh recruitments, which precluded them from competing. It was also contended that the High Court had fixed several other criteria which rendered them ineligible.
