With the Supreme Court collegium putting on hold the elevation of Karnataka High Court Chief Justice P D Dinakaran to the Supreme Court, the judge may be in for further trouble since the Advocate Association of Bangalore is likely to revive its plan to boycott the court of Justice Dinakaran till the probe against him into the allegation of land grab and corruption is completed.
The Advocate Association is likely to hold a general body meeting within the next two days to decide its future course of action in view of the latest developments.
Earlier also, members of the Karnataka Bar Association had appealed to Justice Dinakaran not to come to the court till his name is cleared of the charges of corruption but the appeal was not headed by Justice Dinakaran.
The Supreme Court collegium, headed by Chief Justice of India K G Balakrishnan, has already conveyed to the Union Law Ministry that the elevation of Justice Dinakaran may be put on hold till the probe is over while four others, whose elevation to the Supreme Court was recommended by the Collegium on August 28 this year, may be elevated to the apex court.
The district collector of Thiruvallur in Tamil Nadu had confirmed that Justice Dinakaran encroached upon 197 acres of public land illegally and later also tried to destroy evidence by trying to remove the fencing.
It will be intersting to note whether Justice Dinakaran will continue to be a High Court Judge even if the allegations are found correct in the inquiry.
It may be noted here that a High Court or a Supreme Court judge can only be removed by Parliament through impeachment by a two-thirds majority. During the last 62 years of Independence, not even a single judge has been impeached. Therefore, if ultimately Justice Dinakaran refuses to step down, the CJI can only withdraw judicial work from him and can go no further.
