The order, passed by a Division Bench comprising Justice Anjani Kumar and Justice V K Verma on a petition filed by a number of candidates who could not qualify in the recruitment process, came nearly two months after the Centre had turned down the UP government's plea for a CBI probe into the scam. Allowing the writ petition, the court said "petitioners are unsuccessful candidates and are complainants regarding malpractices adopted in the impugned selection" and hence the locus standi of the petitioners could not be questioned.
