SC Cancels Bbail Of Accused In British Journalist Rape Case 1/22/2009 Taking serious view the rape of the British journalist in Udaipur, Rajasthan, the Supreme Court cancelled the bail of the guest house owner sentenced to life imprisonment by the trial court. A bench comprising Justice Markandey Katju and VS Sirpurkar, however, requested the Rajasthan High Court to dispose of the appeal expeditiously. The British journalist was staying in Pardeshi guest house, Udaipur. On December 23, 2007, the owner of the guest house barged into her room and raped her. According to the victim, she had become an emotional, mental and physical wreck and has had become totally incapable to think and act like a normal human being. The apex court, while cancelling the bail, granted to the convict by the High Court noted, ‘Under the circumstances, without expressing any opinion on the merits of the dispute and culpability of the accused, we are certainly of the opinion that this was a fit case where the sentence awarded should not have been suspended and the accused released on the bail. The High court was thus totally unjustified in granting bail to the accused or in suspending the sentence.’ UNI
