The Supreme Court declined to entertain a petition alleging that the arrest of Sadhvi Pragya Thakur in Malegaon bomb blast case was illegal. A bench comprising Chief Justice K G Balakrishnan and Justice P Sathasivam dismissed the petition telling the petitioner that all these questions could be raised before the trial court. According to the petitioner, at the time of the arrest of the former ABVP member, the police did not have any woman police personnel, even though it is mandatory that a woman can not be frisked or interrogated without being accompanied by a female officer. Sadhvi Pragya, along with other accused, is facing allegations of hatching and implementing criminal conspiracy leading to Malegaon blast, in which several lives were lost.
