SC Declines To Interfere With Pandey's Appointment As Guj DGP 1/13/2009 The Supreme Court refused to interfere in the issue of appointment of P C Pandey as the DGP of Gujarat. A bench comprising Justices Markandey Katju and V S Sirpurkar disposed off as redundant the petition, filed by Citizens for Justice and Peace, an NGO, The petitioner had challenged the appointment of Mr Pandey as the DGP of Gujarat by the Narendra Modi Government, in view of his dubious role during the 2002 communal riots in the state. Mr Pandey, who is to retire in March this year, was the Police Commissioner, Ahmedabad, during the communal riots, which had rocked the state in the aftermath of the Godhra train burning incident in which over 50 kar sewaks were burnt alive. The petitioner had prayed for removal of Mr Pandey from the post of the DGP alleging that free and fair investigation of the communal riots would not be possible if he remained at the helm of affair. Chief Minister Narendra Modi had to remove him from the post of the DGP during the last Assembly election on the orders of the Election Commission of India to ensure free and fair election. The apex court, however, granted liberty to the petitioner, to approach this court if they have any grievance against the investigation of any case related to the 2002 communal riots. Over 2000 people were killed and several thousand, belonging to minority community, were rendered homeless during the riots. The Bench yesterday had reserved the order for today due to the differences between the two judges on the issue of the Gujarat riots. While Justice Katju described the riots as ‘shameful’, Justice Sirpurkar made it clear that the view expressed by him were ‘unilateral’ and he did not agree with it.
