The Supreme Court decided to fix a petition seeking reservation for Scheduled Castes (SC) and Scheduled Tribes (ST) in Post Graduate Medical Science courses in Haryana for final disposal in February next year. Earlier, counsel Krishan Singh Chauhan contended before a bench comprising Chief Justice K G Balakrishnan and Justices P Sathasivam and A K Ganguly that Haryana and Goa were the only two states in India where there is no reservation for SC/ST in Post Graduate Medical Science courses. The counsel, appearing for the petitioner Gulshan Prakash, also contended that this is a violation of the reservation policy of the Union Government under which SC/ST are entitled to 22.5 per cent reservation both in jobs as well as in admission to educational institutions of higher learning. The Union Government is giving 27 per cent reservation to Other Backward Classes (OBCs) in admission to Centrally-run educational institutions of higher studies such as IITs, IIMs and Post Graduate Medical Science courses. According to a nine-judge-bench judgement in Indra Sawhney case, also known as Mandal Commission case, the Supreme Court has fixed 50 per cent as upper limit for reservation. The Court earlier issued notices to Haryana.
