SC Strikes Down The Minimum Age Limit For Appointment As Tribunal Members
The Supreme Court has held that the age of 50 years being the minimum age limit required for Advocates to be considered for appointment as members in various Tribunals is unfair to young Advocates who are meritorious and deserving of such posts. The minimum age limit has been prescribed by the Tribunals Reforms (Rationalisation and Conditions of Service) Ordinance 2021. The age limit bar has been described as arbitrary and discriminatory by a 2:1 majority which comprises Justice L Nageswara Rao and Justice S Ravindra Bhat. The case is of Madras Bar Association V. Union of India.

Union to SC: Scheme For Minorities Do Not Violate Right Of Other Communities
The Union of India has informed the Supreme Court that the schemes introduced by it for the welfare of minority communities do not violate the principles of equality enshrined in the Constitution of India. The rights of other communities are not violated due to such schemes. A plea had been filed before the Apex Court challenging the National Commission for Minorities Act 1972. Last year, a notice had been issued on the plea by a Bench comprising Justice R F Nariman and Justice Ravindra Bhat.

SC: Delegated Legislation That Are Excessively Disproportionate Can Be Manifestly Arbitrary
The case is of Franklin Templeton Trustee Services Private Limited V. Amruta Garg. The decision was given by Justice Sanjiv Khanna and Justice S Abdul Nazeer. It was observed that the Securities and Exchange Board of India (Mutual Fund) Regulations, 1996 that were under contention are not manifestly arbitrary. It was also stated that delegated legislations that are disproportionate or excessive in nature can be arbitrary too.

The Guwahati High Court has observed that the poor has been the worst hit during the COVID 19 pandemic. The Kohima Bench of the Guwahati High Court has opined that the State Government should provide benefits and services to the eligible people under the Food Security Act. The decision was given by the Division Bench which consisted of Justice Songkhupchung Serto and Justice Hukato Swu. The case was of Mhasikhuno Phinyo V. Union of India and 3 Ors.
