Kerala HC: Law Officers And Central Government Counsels Cannot Display Name Of Court On Their Vehicles

The High Court of Kerala has stated that state Law Officers and Central Government counsel cannot display the name of the Court on their motor vehicles as the same was contrary to the Motor Vehicles Act. The Court also issued directions for the regulation of use of unauthorised display of official State Emblems and  the unauthorised use of name boards on vehicles. The plea requesting compliance to the Motor Vehicles Act was heard by Justice Anil K Narendran.

SC: Recovery Of Weapon Used In Commission Of Offence Not Sine Qua Non In Conviction

The Supreme Court has held that it is not sine qua non to recover the weapon used by the accused in the commission of an offence for conviction of the same. The decision was given by the Bench comprising Justice M R Shah and Justice D Y Chandrachud. It was stated that there may be minor contradictions in such cases and the accounts of eyewitnesses could not be put aside for the same. The case was of Rakesh V. State of UP.

SC: Petition Challenging Provisions For Restitution Of Conjugal Rights To Be Heard By RF Nariman

A petition has been filed in the Supreme Court challenging the provisions related to restitution of conjugal rights. The petition will be heard by a Bench headed by Justice R F Nariman. The PIL was filed by Ojaswi Pathak. In the petition, it was put forth that the court mandated restitution of conjugal rights led to a coercive act on the State’s part which violated one’s sexual autonomy, privacy and dignity, which were essentials under the Right to Life and Personal Liberty under Article 21.

Delhi HC: Intellectual Property Division Created To Deal Exclusively With IPR Cases

An Intellectual Property Division has been created by the Delhi High court to deal solely with cases related to Intellectual Property Rights. The decision was given by the two member committee comprising Justice Pratibha M Singh and Justice Sanjeev Narula, which was created by Chief Justice D N Patel. Exclusive IPD Benches are also likely to be created. The High Court will also look into the framing of comprehensive Rules for the IPD.

SC Directs Centre To Ensure That People In Mental Health Homes Are Vaccinated

The Supreme Court Bench consisting of Justice M R Shah and Justice D Y Chandrachud has directed the Central Government to ensure that all people in mental health homes are checked for COVID and vaccinated for the same. The Bench also took note of the instances of the Maharashtra Government shifting mentally ill patients to beggar homes. Since this was against the Mental Health Act, the Supreme Court directed the Maharashtra Government to discontinue the practice.  The PIL was filed by Gaurav Bansal.
