BJP candidate from Pilibhit Varun Gandhi is likely to approach the Supreme Court within a day or two against an Allahabad High Court judgment dismissing his petition for quashing of FIR registered against him for his hate speech against minority community, the Muslims. A case under section 133(A) IPC has been registered against Varun Gandhi on orders of Election Commission of India for trying to disturb communal peace and harmony by delivering inflammatory speech against Muslims. BJP has refused to change its candidate from Pilibhit despite a demand by most of the political parties. Varun Gandhi had challenged the FIR on the ground that Election Commission has acted in a biased manner and did not give him an opportunity to defend himself before ordering registration of criminal case against him. His main defence is that the particular CD is doctored and has been tempered with by his political opponents to malign him. The High Court had, however, found in its judgment yesterday that there was sufficient material to proceed against the petitioner whose mother Maneka Gandhi has been three times MP from Pilibhit. The High Court dismissed his petition under section 482 CrPC for quashing of FIR.
