There has to be the celling of the court fees wrt the matter. In some cases the fees are too high, while in other cases it is minimal. The fees should also be linked to the income of the individual and the approx evaluation of the property as the case may be.

Courts are not only meant for rich people . If court fee is increased thn i dont think poor man could afford fighting for justice

Rendering justice to public is the function of the State - It shall be free. And at the same time misusers of judiciary must be severely punished. That will take care of likely false civil cases.

I know many persons who lost their property because they had no money to pay court fee. Thus where court fee is charged on valuation , the rate should be reduced . But in some jurisdictions where court fee is fixed, it should be revised and enhanced e.g. in writ jurisdiction, miscellaneous applications, accident claims, criminal complaints and applications etc. It is strange that on humanitarian grounds no court fee is payable on applications of an accused when he is in jail but the social reality is that in the same case he pays heavy fee to the counsel and expends for other incidental pairvy much more in comperision to civil litigants.Therefore court fee should be payable on bail applications also.

certainly the court fee for petitions should be increased. A one rupee fee is abysmally low, by todays standards.

court already earning through penalty imposed upon the accused and in recovery suit . fees already is high and out of the reach of poor person. if anybody wants to increase the revenue of the court then stop bribe and curtail the salary of the court staff which has been hicked by the government after 6 pay commision report.

There is no scope of revision as its recession time, people have lost their jobs,there are still layoffs going on and those who have their jobs intact have to face pay cuts. In short the economy has not yet recovered . The current fee structure itself is unaffordable for the common man, increase in court fees will make justice all the more inaccessible.

As of now also court fees are high acting as a hindrance to the common man to look for justice through courts. A alrady high rate of court fees structure couled with the infintie dealy in delivering justice, does not make any case for increase in court fees. I totally agree with Shri Adinath@Avinash Patil. Incidentally, this debate is for Increasing Court Fees and not advocates fees. (I notice that some learned memebers have posted comments on advocates fees).

Justice can not be equated with currency as it should flow naturally even to poor. Fees should be as it is. No increase please.

Dear Friends, unless untill the courtfee increased. The Government cannot increase mor & more courts to provide transperent & computerised informative justice in this 21st century then only our country will become No.1 in the world. Then automatically 3/4 worlds investments flows to India . It automatically gives more employment,more education. Then entire world can say India is for justice. I got lot opinions. In this matter I am ready discuss & comment with anybody and at any time. JAIHIND. Thus people should realise why our courts not yet providing speedy disposal of cases & justice to the public.

well in certain states a lot of luxurious litigation is being pursued, in order to curb this kind of litigation the increase is necessary. Even otherwise, the costs have risen so is the income, therefore there should be a bit of parity in the structure. Let there be a moderate increase.

IF CORT FEES INCREASE AAM ADAMI WILL NOT GET JUSTICE.IN MY OPINION THERE SHOULD NOT BE COURT FEES IN ANY MATTER.JUSTICE SHOULD BE FREE FOR ALL INDIAN CITIZEN.

So far as law of torts is concerned, we indians are still in primitive age amongst other with the reason of court fees in India which makes a litigant to go backward instead of paying the court fees. If in these circumstances the court fees is enhenced the concept of cheap justice would defaet the service of justice.

The maximum number of litigents in India are still belonging to lower class, lower middle class and middle class. The increase in Court Fee will definitely affect them.

It is the duty of the State to provide justice without charging anything and in this age of poverty the court fee should be decreased and not increased.

FEE IS VERY MINIMAL AND FEE STRUCTURE IS VERY OLD FOR ADVOCATES
