If reservation policy in higher judiciary means spreading red carpet to politics which is not a healthy condition currently.

Reservation on the communal basis is untenable in higher judiciary. it would also lead to destandardise the judicial functions. any appointment on the basis of standing in the bar and practise

there must not be any reservation in judiciary as it will lower down the prestige and level of the judges....the adjudication is a very complex and hard to deal matter.. it must be in the hands of competant persons who can impart justice on the basis of true principles of natural justice, equity and good conscience... it will be against the interest of the justice and the judicial system if there will be reservation in the judiciary.. reservation must be discarded/ must not be allowed in any system whether in judiciary either higher or lower , education , or in goverenmental jobs...

The method of selection to the higher judiciary ie. to the High Courts is only through recommendations from the respective highcourts collegium where in there is only chance to a set of people may be by way of caste and money but, in my opinion if theindian judicial service is brought then there is scope that only the merit who have legal stuff will be adorning the chair of the higher judiciary.

MERIT ALONE MUST BE THE CRITERIA FOR JUDICIAL APPOINTMENTS. WHY SHOULD WE GO BACK TO STONE AGE FROM 21ST CENTURY ?

Posted by C Nadarajan

02/11/2008 21:05:50

No. It is not required. When there is no hurdle to elevate the meritorious to judiciary without any difficulty where is the question of reseravation and when political parties are playing their part in recommending their paty persons for judiciary and is being allowed without murmur then the reservation willadd fuelto the fire and no meritorious person will like tocome judiciary. reservation has already severely damage to india's competitiveness. At this rate india will have to outsource middle level business work which is done by 50 -70 % range hurting those very for whom reservation is being thurst

No need of reservation. The survival of the best and fittest has to be chosen on merit. As we are in the stages to reach the domain of developed nation category, the entire system of reservation is not required.

Reservation was ideally introduced in the constitution to balance the caste diffrences in the country, instead the faulty political system has allowed reservation to creep all walks of life. even "GODS". Please spare judiciary out of this disease "RESERVATION".

The topic that "should there be reservation in higher judiciary" itself assumes that judges in higher judiciary are partisan. Why should there be a representation in higher judiciary to people from every caste, creed and religion? What makes us feel that judges are biased as per their own caste or religion and therefore there should be equitable representation? If they are really so biased, we have to discard the entire system of justice dispensation prevailing in India. By making reservations, we will only be enforcing the belief that Indian Judiciary is divided on castes and religions. Justice dispensation is a divine work. Please do not meddle with it.

The work of judiciary is of utmost importance. A wrong judgement if treated as a precedent can badly effect the community/society. The Judges should only be selected on qualifications, experience, Knowledge and expertise.

When we choose something, we compromise with other. When one side efforts are going on for fairness and improvement of our system, a policy which is based on racism (here that is cast base), definitely not fair ethically.

A very strong YES.Because, unless and until the chauvenistic mindset of the upper caste people changes, there cannot be a question of throwing away the reservation policy.Who will uplift the marginalised sections of the society? Only Government can uplift them. There is not even a single day in India, which passes without any attrocities against Dalits. Why the rate of conviction under the SC/ST Act is very abysmal? Why still there are double tumbler systems in the tea stalls of rural India? Why still Dalits are prevented from entering the Temples? Will an upper caste boy marry a lower caste girl? Even if a Dalit boy/girl gets selected in Open Competition Category in some Govt and PSU Jobs, he/she is still being stigmatized and dubbed as inefficient or deadwood. Why there is such a sweep against reservation policy? The people who are conducting opinion polls in the Print&Electronic Medias should reach out to the rural areas of India, then they will understand the necessacity of reservation policy. It is easy speak from the tip of the iceberg but hard to digest the realities. I STRONGLY AND VEHEMENTLY SAY YES TO RESERVATION POLICY AS IT IS THE ONLY SAFEGAURD AVAILABLE TO THE DOWNTRODDEN PEOPLE AND THROUGH THIS SAFETYVALVE ONLY DALITS CAN COME OUT OF THE SHACKLES OF SLAVERY UPPER CASTE CHAUVENISM.

There must not be reservation in any field at any level, As the society and the industry needs quality services. By reservation appointing people of lower quality on the basis of cast, cread and community can't solve any matter rather will decrease the level of quality output.

I think the system of reservation should not be there, in lieu of it the govt. should make the education upto any level, totaly free for the reserved catagory and financial assistance during studentship (stipend) be allowed.

No because person sitting in the higher post has high responsibility. He should possess good knowledge and experience through his own labour. He should come to the position through merits not through reservation/approach.

Certainly No, Let the best of the lawyers become judges irrespective of caste religion. By the way the same applies to other sectors also. THROW AWAY THE RESERVATION ON THE BASIS OF CASTE FROM EVERY WALK OF THE SOCIETY. Instead give free education upto college level to all the poor and downtrodden people
