In addition to Kalpana, I would add that Validity of nomination, scrutiny of nomination and wuthdrawal of candidature are all before the Returning Officer not before the EC. | |

In the absence of any express legal provision prohibiting the Election Commission from giving such direction, I am of the firm opinion that the Election Commission can, and must, direct any political party againist fielding a particular candidate in the election, provided that valid reasons for the same are recorded by the Commission justifying such a direction in the best interest of electoral process in democracy. | |

Election commission has only superintendence power over an election. It cannot dictate who can be nominated to stand as a candidate in an election. Even it cannot make any suggestion in this regard also. It clearly ultravires its powers. Any rejection of a candidate has to be made in accordance with Representation of peoples Act. EC cannot step in to its shoes. | |

How the EC comes into the picture when the nomination hasnt been filed is beyond comprehension? As of now, the law of the land should be allowed to take its own course. The EC does not have any statutory authority to issue a directive of this nature. On the other hand, its purely based on the code of conduct which is not a statutory instrument. | |
