Aviction of tenant

I have rented a jewellary shop in my house in 2005 with an agreement made by Notary.The agreement was of 5 year.

After completion of his 5 years I asked him to vacate my shop but he is not.

He is trying to put the matter before the court and I know that if I move to the court for his eviction it will take time.

 

kindly help me.

suggest some ways

Dear Mr.Kartik,

The Lease agreement for any time period beyond one year has to be by way of registered instrument, mere notarization won't do. hence the unregistered lease deed vests no right or creates no interest in lessee. You can serve him a 15 days notice u/s 106 of the Transfer of Property Act, through a local lawyer. Failing which I am afraid you'd have to file a suit for eviction.
