Brother and Sister Property

My uncle aged 69 and my mother aged 63 are born to same parents. Now my uncle had constructed a house in his portion and one is left vacant at the back side. He has 3 daughters and 2 sons. All the three daughters and 2 sons got married.  Now when my mother go and ask for her legal rights property my uncle says that if she wants she can construct a house in the vacnt place behind but he wont give in written as he fears that my mother will sell the place given to her. I am married to my uncle daughter.

Now could you please suggest me how to proceed further legally.

whether the open site behind the back of your uncles's house is in the name of your mother, if not she can go parition and seperate possession suit.

Thanks for the rep;y sir,

I like to inform you that the land is not in the name of my mother or my uncle (mothers brother) it is still in the name of grandparents I think. This place was not purchased or developed by my uncle. My uncle wa living in hut only. Their childrens only constructed the house in one part. Backside portion they left vacant. 

I like to know that my uncle should mandatory give the property in written instead of oral communication. In which court we can file a suit and in which way.
