I had a farm land at Badlapur which I sold to Mr. Jadhav in July 2015.
We have registered the sale deed with the Registrar Office.
Now, Mr. Jadhav (Buyer) requested to cancel the deed as he dont have farmer certificate.
He proposed as follows:
1) Cancel the registered sale deed at Registrars office, (He will bear registration charges)
2) Execute the Sale agreement with another buyer (his aunt Mrs. Mohite who has farmer certificate)
3) Mr. Jadhav mentioned that he or his aunt dont have money so we should mention in cancellation deed and sale deed to be executed with Mrs. Mohtie that the consideration for sale of land is to adjusted against the payement made by Mr. Jadhav.
Request your guidance on the following:
1) How can I adjust the amount paid by Mr Jadhav against sale transaction executed between me and him agaisnt the fresh sale deed with Mrs. Mohite?
2) What precautions should I take while executing this whole process
