Hi,
A complaint u/s 138 of N I Act has been filed by partner on behalf of partnership firm, without getting any written authorization from any or all of the other parters of the firm. In other words there is no authorization or power of attorny on record in favour of partner who filed the complaint as partner on behalf the partnership firm.
Is it violation of Section 142 of N I Act..?
