Delay in possession

Hi Sir,

 This is in reference to an Appartment bought by me in 2004 and the builder is now offering possession in 2012

without the occupation certificate . There is a delay of nearly 5 years. All payment have been cleared in june 2012 

with only the stamp duty and registration charges are left to be paid. The developer wants us to sign on a

possession letter which cleverly talks of condoning the delay without any compensation, which we have refused. 

Now the developer is talking about charging us Holding charges & Maintenance Charges. We have checked 

at the Senior Town and planning office, the builder does not has the Occupation certificate till date. So can 

they charge us holding & maintenance charges. Kindly advice us .
