Exchange of property

Dear Sir

 

Q.1. My father wants to transfer an Industrial plot which is in his name only through purchase (from his own income), jointly  in my name and in name of my mother. Kindly let us know that how this transger can be done , so that it is not considered a family transfer .

Q.2. And also kindly let us know what is the meaning of  "FAMILY TRANSFER" in legal terms.

Q3. If the above transfer is done by entering into a partnership deed maintaining the name of my father and of me and my mother , then what can be the applicable ratio and wether we are required to form a Firm or a company for such partnership deed. In case of such partnership deed required, wether we are required to pay my father some consideration amount for us to become partners, so that it is not taken as a family transfer and how much consideration is required for the same and wethere we both me and my mother are required to pay seperately to him or this payment can be made by either of us.

Q.4.  If this transfer is done through exchange of a property held by my mother, then wether in the transfer deed my name can be included or not and wether I am also required to pay seperately some consideration amount for adding my name in the transfer deed, which however I can not pay in equal proportion . And if I am required to pay in equal proportion then wether I can pay it later on while earning in installments or lum-sum.

Q.5. Alternately, how our Father can transfer his propoerty jointly in our name , so that it is not considered a family transfer.
