Fake caste certificate

Dear Sir

I want urgent suggestions for one of my query. Any lawyer may contact me also.

My friends father has been charged by getting job with fake caste certificate. The scrutiny committee has confirmed his caste as General.

His father has obtained caste certificate in 1980, at that time all his relatives were getting back ward certificate. from 1983 on wards , OBC certificate was not issued but of general was issued. That caste was not listed as general. means that OBC caste is still existing. Now in caste certificate issuing office , no record is available before 1990 issued certificate.

Caste scrutiny committee comprising DM didnt verified 1980 caste certificate but written based on present issuance of caste certificate as well some ancient land record.

They didnt attached their family history.

Now my question is

How he can proof his genuineness

1) since all of their relatives had OBC certificate how he can deny them

2) Does department will check service was provided on OBC or they will take action itself.

3) He has Backward caste samaj certificate with him, issued recently to his nephew.

4) Villagers has written that they were getting OBC certificate in 1980 But not now, is this be considered as proof.

5) He has served for 34 years , will he get any relief.

How to proof genuineness? Pls suggest

you are not even stating that how and where and on what arguments is he being charged. whether it is criminal trial or departmental inquiry.

It is very simple that during the year there was no system called OBC but now it is there however the said community was falling under the backward class then and now and since you have proof of the villagers of the same community as well his nephew possess the said community certificate, it is a valid proof to prove his backward community status, however let the authority of the office prove that he produce the fake certificate, then with the help of evidences in your possession , you can challenge the case.

Thanks for your reply.

Actually he is facing an RTI against him.

Departmental procedure and criminal procedure is not yet started. But they are frightened. So i want to help them.

to make case simple

1) The authorities have only stated that he belongs to general caste (based on land record and current condition of issuance of general caste ) and some how they were getting backward caste certificate and not now.

2) He has his backward caste name in school,inter and college as well.

3) backward caste community certificate issued to his nephew.

4) some relatives 5-6 having same backward caste certificate dated back to 1995

5) Villagers has signed that they were getting backward caste certificate at that time from administration.

Is this enough to proof in department enquiry or in case if in court.

pls suggest, is there any condition on which they can catch them

what exactly do you mean?

do you want to say that he is general category and the department is applying for bogus certificate for him.
