Grandfather Property

 

I am listing out the detials below for my query regarding a family property at Ajmer (Rajasthan). I just want to know should I go and fight for it or no. If yes then on what grounds I can fight and what are my chances of winning and what kind of time it can take.

My grandfather had three kids 1 daughter and 2 sons. He had build a house in ajmer. In his will property is split between his both sons. Elder son was given responsibility to execute the will basically some responsibility becasue my father the younger son was alcholic. My Grandfather wrote in his will that no one can sell this house or give on rent. My both sons and their families can only live in the house. Both the sons are alive. He also added an alcholic person wont have any right in my property. He wrote this in a hope of my father quitting alchol.

Two years back elder son bought the house by giving only 5% of the original valuation from the younger son, my father. All papers were signed etc. etc. All these papers were signed infront of witnesses. I was told plz come we want to buy this property and other things. I said I dont want to sell it and neither I want my father to sell it. So I dont want to come. Still all this happeneded and I didnt come to know about it.

When I came to know about it I went to a lawyer in ajmer. He helped me in sending a simple notice to my Uncle the elder son. What they have done is wrong etc.
They replied back to the lawyer saying all of it is right and I have given wrong info. to my lawyer.

Now I have all the papers including a xerox of my grandpa's will. We will discuss more over the phone and I will give you more details. Akanksha just need to know what should I do with this scene as I want my property back. My father is on my side now as he needs money for his alchol.

premises are occupied by my uncle family. Before my father and uncle family lived there. As soon as my uncle gave the money to my father he vacated the place.

My parents are separated since 20 years but an official divorce never happened.

Do I stand a chance here?
