Hiding employment details in tpc as well as crmp at high court

If wife filed a transfer petition for transfer divorce case at their parental home and CRMP to restore dismissed DV case mentioning that she is unemployed and take of care of her children(In DV case she and her council not attended for three consecutive dates,so DV case was dismmised)

But wife is hiding her job details.

After hearing ,transfer petition is also allowed.

 

Under which section husband can invoke case against wife if she is hiding her employment details to get favorable order at High Court.

If she had mentioned any employment reason seeking transfer you could have proved her as making false claim on the basis of the documentary evidences in your possession.

If she is filing a petition to restore the dismissed DV case, you can produce those documents before court during arguments for maintenance claim.

If you have found some misinformation of your wife submitted before the court, collect documentary evidence to prove misinformation and move an application u/s 340 CrPC through your lawyer.

What is the opinion and advise of your counsel who is well aware about facts and circumstance of the case, an intelligent, competent and able lawyer ?

The best option for you to meet the DV case on merits. In the given facts, running after trivilaities may not serve much purpose other then than wasting time and resources.

Filing an affidavit by stating that she is jobless amounts to perjury. If you are able to prove this with documentary evidence, you have a good case.
