House vacated-registed site not given

Sir,

I have purchased a vacant house site near chennai by regd.document in 1991 from a site seller in the area(one among 14 sites developed by him). During 1999 when I thought of constructing a house, enquired with the seller and he told that there is encumberance(the document clearly says "if there is any encumberance happend at or after the date it will solved by me")in the land and I give you another site against it. As he is very known to me, I did not taken these in writing from him. He given me a site on which I constructed a house in 2002 without registering it on my name(the seller claimed that the land is in his wife name). During 2006 another person claiming the alternate site(where house constructed) as his own patta land and grabbed by vacating me from the house. The seller did not came to my rescue. Till date the matter is not solved by the seller despite repeated requests. By police intervention, he given in writing, that he will give another site and register in my name against the dispute site and now he escapes from his house and his wife wants me to go to his lawyer to solve the matter. Shall I go for filing case with court or petition with Tamilnadu police commissioner under land grabbing act(recent rules).
