Legal Rights of a Member

We have been members of a housing society for 7 year. Over the past 5 years we have been facing a problem of water dripping through our toilet, bathroom and kitchen ceiling. We have communicated several times to the various Management Committees that have taken office over these 7 years regarding the same, but no avail. At present the situation is so bad that water has seeped through the walls and is starting to drip from the ceiling of the flat below us. This situation is present throughout the year and intensifies during monsoon. Please let us know what are our legal rights in this regard.

i think you are the purchase of house from housing society and the house is in bad condition.  if it is correct, this comes under the purview of the Consumer protection Act.  You can file complaint against the society before the concerned Consumer Forum

Thanks for your response. We have put forward several complaints to the management committees to no avail. Can we file a Police Complaint since there is  a danger to life and property. WeWould also want to file a complaint with the Consumer Forum. Will that help?

If you are the owner of the house, then you cannot file any police compliant against the society.
