Nomination by joint holders

hi,

my father and mother are joint owners of the flat we all stay in. they wish to nominate each other as nominees i.e. in event of my father'd death his rights on the flat should be transferred to my mother and vice-e-versa. we had consulted one of our legal advisor and were told that we can do such kind of nomination. when we submitted the nomination form in Appendix 14 to the society, the legal advisor of the society says my parents cannot nominate each other as nominees. is this right? what if the owners dont have any kin? in such an event why cant an owner nominate the joint owner as nominee?

secondly, also wanted to know within how many days of submission of nomination form to the society, should they return us the duplicate and tripicate copy of the nomination? we were told that the duplicate copy has to be acknowledged immediately and returned back by the society whereas the triplicate copy has to be returned after this nomination issue is discussed in the managing committe meeting taken on records. is this right? please advise on urgently as our case is worsening day by day and society officials are really a nuisance to deal with.
