Refund of money from the builder

Dear Concern

I have a question, please guide me on that...

I have approached a builder to purchase a property and had finalised a Flat. The rate of the flat was finalised at 46 lacs for a 3 BHK. Accordingly I applied for a Home Loan in LIC Housing Finance. Home loan of Rs.20 lacs was sanctioned.

The Builder has sumbitted the sale deed on his personal name and the sale amount he had mentioned is Rs.24 lacs only. Initially I signed on the paper. In sale deed details of the flat like size and area was not mentioned, only the address of the flat was mentioned with the owner name.  Due to various others reasons, I decided not to buy the flat. So I request the builder to refund the Money ( Rs.14 lacs) which was wire transfered to his and his associate accounts on different dates. I have the full details with me to proof it. But no receipt of the same. All the money was paid in good faith and through RTGS.

He asked me to give in writing that I donot want to purchase the flat and he is free to sale the same to any thord party. I wrote the letter stating that he can sale the Flat subject to return of full amount to me which was paid to him in different accounts as per his demand.

Now after one month he is not ready to refund the money and whenever I call him he is giving excuse that after selling the flat, he will return my money.

Can any one guide me what should I do in such case. If I lodge a FIR, which section I should emphasis on to register ?
