Regarding rent on property

Hello everyone.

My father was holding a medical shop on rent for 28 years. We were paying rent every month for which we have receipts now after his sudden demise, the landlord is planning to take it back. He was giving the receipts on my fathers name now my mother wants to run the business what if he refuses to give us rent receipt or either refuses to take rent. We are in process of creating a new license for her whic will take some time . My question here is does the landlord holds a chance of taking it back or what should we do if he refuses to give receipts on my mother's name.

Any help will be greatly appreciated.

Dear Mr.Shobhit,

You've not mentioned which state you belong to, because that would be pertinent to adjudge what law is applicable on this property.

You'd also have to tell whether there was a lease agreement or not - the initial term ? the rent payable per month etc.

Hi Bharat thanks a lot for your reply i am from Kanpur (UP), there was no lease agreement as per my understanding abd the rent which he is charging is 800rs(increased from 575 this month).

Please advice.
