We had 2 property which was bought by my father and the orignal agreement has names of my father , mother , uncle and aunt , 12 years back my father expired and then in 2006 my uncle and aunt had released a family deed agreement which mentions that myself and my mom are the legal hires ( i do not have any brother or sister as im the only son )and they resign their rigths from our commercial property and have no objections that their names to be deleted and inlcude my name in society & share certificate , based on which the same was done .The NOC was also Notarised .
Similarly we ( Mself and my mother ) had released our rights from the resiidental property and handed over to my uncle and aunt.
Need Clearification - The same Family deed was notarised and it was stamped as attested copy by the advocate who noatrised it.
Inorder to get a clear document please advise .
1. If we sell the commercial property based on this family deed , will my uncle or their legal heirs can create any problem in future .
2. If thisFamily deed is not registered and only Notarised , is it mandatory to register the same and how sine it was made in 2006 .
3. Should i make a fresh release deed exchange and register it as per todays date
4. Will i have to pay the stamp duty on the new release deed./ Family exchange deed .
5. Way best to clear my commercial property as per documents and to have 100% rigth jointly by my mother and myself .
