WHETHER A SALE DEED CAN BE CANCELLED?

Where a Sale deed in respect of an immovable property worth more than Rs.100/- is not registered, the ownership of the property does not pass from the seller to the buyer and the transaction will be wholly uneffective. The subsequent transferee will not have any right to the property on the basis of the subsequent registered Sale deed and the only remedy he has against the transferer is to file a suit against him for the recovery of the purchase money paid to him.

If the sale deed is registered at Registrar Office then u cancle this sale deed with pay actual stamp duty and registraiton fee. If the sale deed is registered and u are not cancle so the title of the property is defective.
