I have a flat in a redevelopment building. I am getting my redeveloped flat in the new building. I am the original member in the building. The builder is offering us the soft possession of the flats constructed. The builder has not applied for the OC (occupation Certificate) since the last 3 floors internal work is still pending.
There is also no clarity weather the builder has obtained the CC ( completion certificate).
Some members of the society are ready to accept the soft possession and settle down in the flats while some are not.
Possession without OC is not legal but there is no clarity about the legalities of soft possession.
If the members take the soft possession and start the work....the maintenance and the subsequent responsibility and costs of obtaining the OC would be on the builder or on the society?
