Respected lawyers and advisors - Im in Mumbai. My grandfather had two ground floor houses. He paased away in 1989. My mother had moved out of the house with her four children as dad used to physically assault us (police complaint was registered). But no divorce happened. We lived in a rented house for 22 years. I was living in y gandfathers house for 4 years. Then my uncle told us that house needs to be repaired. We bought a very small house away from mumbai for sometime. Of the two houses, he (my uncle, dads brother) sold off one house. It has the signature of my grand mother and uncle only, not my dads. This was the property verbally designated as my fathers share. He then gave part of the other house on rent. He has not been allowing me or my brother or mother to visit the house. My grand mother is alive but she does not want to do anything legally as she is scared of my uncle. Property is in Grandfathers name and there is no will. I have been giving my grandmother her expenses for the last ten years. My uncle doesnt give her any expense money. Now actually since my uncle sold the house (his signature) the current property should belong to my father. My father is not mentally stable to fight a case (no medical evidence though). They have two sisters. Sisters have verbally said they dont want anything. We have no house to live in. And its impossible to buy one in Mumbai now. My uncle has one son. My father has two. Of the 2 houses that were my grandfathers, my uncles signature is on the sale deed of one. And he has tricked us into occupying the other house. What are my legal options?
