नई दिल्ली.marrige cartoonअब हिंदुओं में तलाक लेने की प्रक्रिया और सरल हो जाएगी। प्रधानमंत्री मनमोहन सिंह की अध्यक्षता में गुरुवार को केंद्रीय मंत्रिमंडल की बैठक में इसके लिए संबंधित कानूनों में संशोधन को मंजूरी दे दी गई। इससे ऐसे वैवाहिक रिश्ते जिनमें सुलह की संभावना नहीं है, उन्हें संबंधों में विच्छेद का आधार मानते हुए जल्दी तलाक मिल सकेगा।



इसके अलावा परस्पर सहमति वाले मामलों में भी कार्यवाही में तेजी आएगी। कानून मंत्रालय ने इसके लिए हिंदू विवाह अधिनियम 1955 और विशेष विवाह अधिनियम 1954 में संशोधन का प्रस्ताव रखा था। सूचना एवं प्रसारण मंत्री अंबिका सोनी ने बताया कि प्रताड़ना के कारण तलाक की अर्जी देने वाले पक्ष के संरक्षण के लिए यह प्रावधान किया गया



हिंदू विवाह अधिनियम की धारा 13-बी और विशेष विवाह अधिनियम की धारा 28 में तलाक के लिए आपसी सहमति को आधार माना गया है। कोर्ट इस आधार को लेकर संतुष्ट होने पर तलाक मंजूर कर सकता है। लेकिन देखा गया है कि एक पक्ष जानबूझकर मामले को खींचने के लिए अदालत में नहीं आता जिससे तलाक की अर्जी लगाने वाले पक्ष को बेवजह परेशानी होती है। इसे देखते हुए विवाह अधिनियम संशोधन विधेयक 2010 लाया जा रहा है।



क्यों जरूरत पड़ी



मुकदमे की कार्यवाही लंबी खिंचने से दूसरे पक्ष को दिक्कतें होती थीं। अब यह विधेयक उन्हें सुरक्षा प्रदान करेगा, जो सहमति से तलाक चाहते हैं।



तो क्या आसानी होगी



हां, अधिनियम में बदलाव से अब यदि दंपति में कोई एक दूसरे के साथ रहने से मना करता है तो तलाक मिल सकेगा। बस, कोर्ट को भरोसा दिलाना होगा कि अब वे साथ नहीं रह सकते।

I BELIEVE THAT DIVORCE IS A PERSONAL LIBERTY AS THE MARRIAGE IS.

NOTHING CAN COMPLE ONE TO RESUME A MATRIMONY, WHICH IS ALREADY LOST.

MEDIA REPORTING THAT - 'IRRITRIVIABLE BREAKDOWN OF MARRIAGE' IS GOING TO BE ADD AS A GROUND FOR DIVORCE.

BUT I AM IN DOUBT OF IT.  BECAUSE THE MAIN FOCUS OF THE NEWS IS ON, - SEC 13B IE MUTUAL DIVORCE, AND NOT IRRITRIVIABLE BREAKDOWN OF MARRIAGE.

HERE I WANT TO DRAW THE KIND ATTENTION OF THE MEMBERS THAT, -

SMT SHRUTI SHINDE, WHO IS DAUGHTER OF  THE CABINET MINISTER AND TOP LEADER OF MAHARASHTRA CONGRESS, MR SUSHIL SHINDE IS BEING REFUSED BY THE COURT FOR MUTUAL DIVORCE - AFTER REFUSING MUTUAL DIVORCE BY HER HUSBAND.

ON THE OTHER WAY, AS THE HUSBAND OF SHRUTI, -  REFUSED SHRUTI - FOR MUTUAL DIVORCE, THE COURT REFUSED SHRUTI FOR MUTUAL DIVORCE.

I AM AFFRAID / ANXIOUS THAT TO REACH THE BENIFIT TO THIS PARTY, THE PRESENT AMMENDMENT GOING TO BE MADE, AND NOT FOR A GENERAL CAUSE OF PEOPLE'S HARASMENT ON MATRIMONY. THEREFORE 'IRRITRIVIABLE BREAKDOWN OF MARRIAGE' MAY NOT BE ADD AS A GROUND FOR DIVORCE OR IF ADDED – IT ADD IN SUCH A MANNER THAT COMMON PEOPLE, HAVING NO HIGH APPROACH, CAN NOT GET –

‘JUST’  ON MATTER.

THAT'S WHY the TEXT ON THE MATTER IS ABSOLUTELY NECESSIRY AT THIS JUNCTURE.

In my case, I have pronounced Talaq as per muslim law & custom with proper time-interval (IDDAT period) and have filed the record of the Talaq in the local community mosque where the marriage was solominized.

A mediation was attempted through the community elders and finally after the IDDAT period was over a Third and Final Talaq was pronounced.

Though its a muslim divorce, Will the court consider this a valid Divorce ?

If YES, why ?

If NO, Why

Please explain

the answer is 'yes'. because it is law of the land.

parliament approves it for mohamedans. this is a lawfull divorce for muslims.

it is that news, where mutual divorce and irritrivieable breakdown of marriage going to ammend for the hindu marriage act.

What about Indian Divorce Act 2001. Would it be applicable for petitions filed under Indian Divorce Act? I suppose No. Thoughts of experts please?
