Apartments can a co-flat owner be punished according to welfare society bye laws?

One of apartments owner has been failing to pay common and maintenance charges for a consequetive two years now. Amounting Rs. 50,000/-. Welfare society bye laws stipulation disconnection of E.B (electricity connection) for non-payment. What is the legal discourse to the defaulter? Thanks for the lawyer community for my upcoming answer.

Is the flat occupied or vacant.

If tenent exists Society can demand dues from tenent If flat is locked Society can file Civil suit for recovery. The Hon.Court may order auction of flat if warranted.

Better you approach Society for settlement before it is too late.
