Appointment of a court commissioner in rent act matter

Sir,

A case of Rent Act Eviction and Declaration under The Maharashtra Rent Control Act 1999 has been filed against my friend and the case is in an expidiated stage . My friend is living in a dilapidated condition as water keeps on leaking from the landlords house.  The landlord says that he is not responsible for the maintainance of my friends house since my friend is disputing the title.

Now the case is at the evidence stage. Pls let me know if a Court Commissioner can be appointed so that the commissioner can verify the status of the house and if the court can give permission for some repairs.

normally in eviction cases no stay is granted for status quo...first you chek whether there is any stay oprating in the matter....if there is no stay u can get the miner reapirs done on ur own expences....

in case there is stay oprating then u can move the court for seeking permision of repairs....appointment of commissioner is of no use.
