Biological daughter right on fathers anceister property

Dear Sir/Madam,

                              My sister is australian citizen with OCI card. She is fed up with his husband from past 10 years and she is planning to divorse with him. They have a daughter of 8 years. What are the chances of getting her to my sisters custody. Could she claim her ancisters and his own earned property( purchased property amount given by my sister) for her minor daughter. Could we claim maintenance on him for her daughter. Now her employment contract is ending now , based on this shall we claim maintenance for my sister till getting her job or remarried.

Your sister would not get maintanence as she was working and is capable of working and has the capacity to work ,but if she is given custody of the child than she can claim for maintanence for the daughter or else if custody is given to your sisters husband than she would not even get maintanence for the child . As a matter of fact as your sister  is earning both would have to contribute for maintanence of the child .
