Buying a property in bank auction ( sarfaesi act)

Dear Friends,

Iam planning to buy a residential property  which is getting auctioned by the Bank in Chennai under sarfaesai act.

Need your advice and the suggestion on the below points.

The owner is not residing on the building.

Owner has given the property on the lease for the tenant who is occupying the property.

Tentant has filed a writ in debt recovery tribunal againts the eviction.

In the event of the winning the bid Iam intend to move to the property for residing as Iam staying in the rented house.

Pls suggest whether I can particiapte in this bid or not ?

What will be legal complications in this ?

Advance thanks

You can participate in teh bid and you can ask the Bank to get the physical possession of the proeprty and then to deliver you. Otherwise, you can get teh rent ofteh said proeprty from the tenant.
