Car extended warranty

Dear,

I bought a TATA CAR  in aug 2011 AT that time they insisted to buy EXTENDED WARRANTY which i also bought at that time.

I was not told that it was covered by insurance company.. i thought it is just extention of warranty ..even the manual which is provided dont clear anywhere  about cover under insurance

Anyways the issue arised when i am in need of it as one of my part of car is not working and  manual i was provided  clearly stated about the coverage of part

i requested them for 3  months ..through emails, calls tweets..but they rejected to cover it under warranty

even they provided me the rejection letter

> can i make appeal in consumer court as they  promised me in manual and now they are rejecting

please tell me the procedure..and the documents which i need?

Thanks & regards .!

For how many months or years was their normal warranty? For how many more years or months was their extended warranty?

Warranty and insurance are two different things. When a manufactured product is sold to you, it can fail due to defect in manufacture. A warranty covers such failure. It would not cover failure due to wear and tear during use or abuse or failures due to aging. When the product is of good manufacture there should be no need to invoke the warranty at all if the product is good. When you buy a product you may not put it to use  in all the manners it can be reasonably put to use within a short period. Further defects in certain parts may not appear in a short time. In order to cover all such possibilities a warranty is given for a certain period. In most cases for  all kinds of products it will be one year. The principle here is that when there is an inherent defect in the product it will appear within one year of use. Sometimes the manufacturer may give warranty for a longer period. But that should be voluntary and free of any additional cost if the manufacturer is honest. Even if a defect appears within the warranty period it will be difficult to prove whether the failure was not normal wear and tear or abuse or it was an inherent defect. The manufacturer or dealer can easily dispute your claim. Hence any warranty which the manufacturer gives on payment basis is plain cheating.

Warranty is always given by the manufacturer or by the dealer on behalf of the manufacturer and not by the insurance company. Insurance only covers theft, damage due accident etc. Warranty and insurance are mutually exclusive. What is covered under warranty will not be covered under insurance and what is covered under insurance will not be covered under warranty.

Have you read the warranty document? It will give all the exclusions. It appears to me that the manufacturer has taken you for a ride in the car he has sold to you. You can approach the consumer court.
