Recently HC has upheld a Civil court judgement in favour of the Flat purchasers. The builder has changed his plans & added additional building in the plans to utilize the extra FSI he had received.
Our case looks similar. In all our sale agreements the builder had shown an area of plot as Recreational Garden. Recently he has submitted a new layout plan to Thane Municipal corporation, in which he has shown a new building in place of the recreational garden. Moreover he has not yet formed a Society. His work for society has been initiated very late.
We spoke to an advocate who advised that we must go to High Court. Civil court would be of no help in this regards. Our case sounds similar to this one. I am giving the article link here.
