'  cheque without money is just like paper. in criminal proceeding , if accused can not explain --how cheque reached to prosecution. still can court punish to accused for paper like cheque .pl suggest.

cheque is a negotiable instrument. After three months from the date of cheque it bacame value less. It is called stale cheque. But not white paper

under NI Act accused will be punished only if complainant can prove that the cheque was issued to pay some legal liability and it was dishonored due to insufficient fund or some other reasons and if complainant is not able to prove it accuse will not be liable for dishonor of cheque.

cheque is only like a waste paper ,if it has not backed by consideration.the prosecution or accuse--is open to them to prove/disprove the crucial fact
