collaboration agreement

i am from delhi and would like to enter into a collaboration agreement with a builder to have my house reconstructed

 

i am giving builder the general power of attorney for selling his share after construction

 

do i need to get my collaboration agreement registered for it to hold value in a court of law in the case of a dispute

 

could anyone please tell me what would be the stamp duty for gettimg it registered

Dear Sarthak

You should execute devlopment agreement, in that you have to mention after completion of devlopmant builder has right to sale his share and not before. You have to adjudicate that Devlopment agreement from authority for appropriate stamp duty. Also give power of attorney for devolopment and not for sale, you may mention in that as per devlopment agreement after completion of the structure he may sale.  There is no need to register this agreement but you can register it for your protection.
