Construction of a building and stay order

Hello,

We bought a plot in 89 and in 93 our neighbour who is goonda type broke the wall at night and filed a case that we have encourached a part of the road. we had been fighting a case till this year upto high court. The high court in its decision asked the neighbours to prove it and refrained us from construction on the road. We had the wall on our plot and never encourached the part of the road. Now we want to start a construction. HUDA has passed the plan for construction.

Can the neighbour file a case again and get a stay order? What do you suggest us so that we can start the construction?

if huda has  granted  you permission you can  start constructiion. high court has restrained you from constructing on road side . while constructing see to it that you dont violate high court orders. consult your local lawyer who fought your case in high court .

 

address a letter to local police station enclsoing copy of permission garnted by HUDA and inform them thata s per permission granted you are constructing on your plot of land

Please also clarify,

1. the neighbbours cannot take stay order, and

2. we can expect police protection if neighbour does some goonda-gardi and creates issues on the site, provided we submit the documents to the police as per your advise.
